This agreement, together with the RolaProxy Privacy Policy, RolaProxy Service Quality Assurance and Balance Refund Policy, and RolaProxy Compliance Use Statement, constitutes the complete legal document system of RolaProxy services and has equal legal binding force. These documents are complementary to each other. In case of any inconsistency between the terms of this agreement and other documents, this agreement shall prevail. Where other documents have stricter provisions, the stricter provisions shall apply.
I. Definitions and Explanations
1.1 RolaProxy/We/Service Provider: Refers to JUBASE TECHNOLOGY LIMITED, registered address: Room B, 9/F, 9042, Sino-US Centre, 15-17 Hing Yip Street, Kwun Tong, Hong Kong, operating website: https://rolaproxy.com.
1.2 Services: Refers to all network proxy services provided by RolaProxy, including but not limited to residential proxy, data center proxy, static proxy, and supporting API interfaces. Specific categories are subject to real-time announcements on the RolaProxy platform.
1.3 User/You/Customer: Refers to natural persons, legal persons, or other organizations using RolaProxy services.
1.4 Account Balance: Refers to the total funds balance in a user's account, including "cash recharge balance" formed by the user's own funds, and "gift balance" obtained through platform activities, gifts, coupons, etc.
1.5 Proxy Service Consumption: Refers to the actual consumption incurred by the user through extracting or using proxy IPs, including but not limited to the consumed amount under models such as billing by IP quantity, billing by traffic, and billing by usage time.
1.6 Terms of Service: This agreement and all its attachments and supplementary policies are collectively referred to as such.
1.7 Related Documents: Refers to the RolaProxy Privacy Policy, RolaProxy Service Quality Assurance and Balance Refund Policy, RolaProxy Compliance Use Statement, and other policy documents subsequently issued by the platform.
II. Scope and Effectiveness of the Agreement
2.1 This agreement constitutes a complete legal agreement between you and Rolaproxy regarding the use of various online proxy services provided by us (currently covering residential proxies, static proxies, etc., specific categories are subject to the real-time announcements on the Rolaproxy platform).
2.2 This agreement is highlighted in a pop-up window on the registration page. You must manually check "I have read and agree to the RolaProxy Terms of Service" before completing the registration. Those who do not check "agree" will not be able to complete the registration and use any services.
2.3 Given the rapid evolution of internet business models, the main text of this agreement may not exhaustively cover all applicable rules, nor can it predict new situations that may arise in the future. Therefore, all current and future policy documents issued by Rolaproxy (including but not limited to the Privacy Statement) automatically form an integral part of this Agreement and have the same binding force as its terms. By using Rolaproxy services, users are deemed to have fully read and accepted all the contents of the aforementioned documents and agree that they will apply synchronously with platform updates.
III. Account Registration and Management
3.1 Registration Requirements
You must complete the registration process by providing accurate, complete, and up-to-date information to create an account. You represent and warrant that you are legally qualified to sign this Agreement and that all information you provide is true and valid.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials (username and password). You are responsible for all activities occurring under your account, whether or not they are authorized by you. If you discover any unauthorized use of your account or any other security breach, you agree to immediately notify RolaProxy officials.
3.3 Account Verification
As a security measure, RolaProxy recommends that you enable two-factor authentication. We also reserve the right to request additional information or documents from you to complete identity verification or compliance reviews to enable specific services.
IV. Service Content and Quality Standards
4.1 Service Scope
RolaProxy provides services including but not limited to residential proxies, data center proxies, and static proxies.
4.2 Service Quality Commitment
4.2.1 IP Connectivity: We commit to a service availability rate of no less than 95% for the proxy IPs we deliver to you (monthly statistics). The calculation method is: Number of successfully established connections in the current month ÷ Total number of requests in the current month × 100%.
4.2.2 Fault Judgment Criteria: Service unavailability means that the proxy IP cannot establish any TCP connection within 5 consecutive minutes; Abnormal IP quality means that the extracted proxy IP cannot connect to the target server within 30 seconds or the timeout rate exceeds 50%.
4.2.3 Platform Line Failure: If the service is unusable due to a failure of RolaProxy's own servers, network lines, or system, and this failure lasts for more than 30 minutes, users can submit a fault report through customer service or email. If we verify that the failure is indeed the platform's responsibility, we will refund the service fee for the corresponding period.
Chapter 5 Fees, Payment, and Refunds
5.1 Fees
You agree to pay all fees incurred under your selected service plan. All fees are denominated in US dollars or the currency specified on the website.
5.2 Payment Processing
Payments will be processed through a third-party payment processor authorized by RolaProxy. You agree to provide a valid payment method and authorize us or our payment processor to charge fees for that payment method.
5.3 Price Changes
RolaProxy reserves the right to adjust service pricing. Any price changes will be announced on the website and will take effect from the date of announcement. Continued use of the service after the price changes take effect constitutes acceptance of the new price.
5.4 Refund Policy
5.4.1 New User Trial: New users are eligible for a limited-time trial. For designated products such as static residential proxy, if you are unable to use the service normally within 24 hours of purchase and our technical support team is unable to resolve the issue, you may apply for a full refund.
5.4.2 Pay-as-you-go Products: For pay-as-you-go services with data plans, once the order is activated or you have already used the proxy IP, cash refunds are generally not provided. In case of quality issues, the compensation mechanism in the RolaProxy Refund Agreement applies.
5.4.3 Wallet Balance Refund: Cash recharge balance in your account (excluding bonus balance) can be refunded via the original payment method if it has not been used to purchase any packages. We will deduct 5% of the recharge amount as a handling fee. If the recharge balance has been partially or fully used to purchase packages, cash refunds are not supported; unused balances can be retained in the account for future consumption. Bonus balances and activity rewards cannot be withdrawn or refunded. Refund requests must be submitted within 90 days of the recharge date.
5.4.4 Special Note for EU Users: If you are located in the European Economic Area (EEA), you are legally entitled to a 14-day cooling-off period to withdraw your purchase of digital services. For details on how to exercise this right and applicable conditions, please refer to Article 5 of the RolaProxy Refund Agreement.
VI. Acceptable Use Policy
Your right to use RolaProxy services depends on your strict adherence to the following terms. You may not use the Service for, or permit others to use, the Service for any of the following purposes or activities:
6.1 Circumventing Internet Regulation
Using this Service to circumvent the internet regulatory policies of your jurisdiction, access restricted websites overseas, or engage in any activities that violate local internet regulations is strictly prohibited. This is a core red line for users in mainland China; violators will be considered serious offenders and will be subject to permanent bans under Section 9.3 of Chapter 9 of this Agreement.
6.2 Illegal Activities
Violating any applicable international, national, state, or local laws, regulations, or ordinances, including but not limited to activities involving organized crime, fraud, money laundering, terrorism, or any other criminal offense.
6.3 Malicious and Destructive Conduct
6.3.1 Cyber Attacks: Initiating, participating in, or assisting any form of Denial-of-Service (DoS) or Distributed Denial-of-Service (DDoS) attack, or any act intended to disrupt, damage, or interfere with any network, server, service, or other infrastructure.
6.3.2 Malware: Distributing, spreading, hosting, or advertising viruses, worms, Trojans, ransomware, spyware, or other malicious code or harmful software.
6.3.3 System Abuse: Interfering with or disrupting the integrity or operation of the service or any third-party data contained therein, or taking any action intended to damage the reputation or goodwill of RolaProxy or its partners.
6.4 Financial Fraud and Crime
6.4.1 Financial Website Attacks: Unauthorized access to, attacks on, crawling, or attempts to obtain any website or service related to financial transactions, banking, securities, cryptocurrency exchanges, payment gateways, or insurance.
6.4.2 Fraudulent Activities: Engaging in any form of fraudulent activity, including but not limited to mobile advertising fraud, click fraud, install fraud, affiliate marketing fraud, credit card fraud, phishing, identity theft, or any other deceptive scheme.
6.5 Inappropriate Content and Activities
6.5.1 Prohibited Content: Accessing, distributing, disseminating, or participating in any content or activity involving child sexual abuse, non-consensual pornography, gambling, drugs, violence, hate speech, or any other content or activity that violates public morals and laws and regulations.
6.5.2 Harassment and Infringement: Harassing, threatening, defaming, abusing, or infringing on the privacy, intellectual property rights, or any other legitimate rights of others.
6.6 Privacy and Data Scraping
Doing any unauthorized scraping, collection, or use of data, especially involving personal privacy, sensitive information, or protected information. You may not use our services to collect data unless you have received explicit authorization from the target website.
6.7 Circumvention and Competition
6.7.1 Circumventing Security Measures: Attempting to circumvent the security measures or authentication requirements of any website or service.
6.7.2 Competition and Benchmarking: Using the service for benchmarking or similar competitive analysis, or creating any product or service that competes with RolaProxy.
6.7.3 Reselling Services: Selling, reselling, distributing, providing, renting, or leasing any service without the express written permission of RolaProxy.
VII. Log Retention and Data Compliance
7.1 To fulfill our legal obligations and ensure service security, we will record the following information:
- Basic account information (registration information, authentication information);
- Proxy access logs (target domain name, timestamp, traffic data).
7.2 The above log information will be stored for no more than 90 days and will be automatically deleted upon expiration. If data needs to be retained beyond the legally mandated period due to legal requirements such as requests from judicial authorities, ongoing litigation, or administrative enforcement proceedings, the relevant data will be isolated and sealed from regular operational data for use only in accordance with legal procedures. It will be deleted immediately upon completion of the procedure.
7.3 Log data will never be used for user profiling, advertising, or sold to third parties. See the RolaProxy Privacy Policy for specific rules.
VIII. Service Suspension and Termination
8.1 RolaProxy's Rights
RolaProxy reserves the right, at its sole discretion, to immediately suspend or terminate your access to the service without prior notice in the following circumstances:
8.1.1 We reasonably suspect that you have violated this Agreement or any supplementary policies.
8.1.2 You fail to pay any due fees on time.
8.1.3 Your use of the service poses a security risk or adversely affects RolaProxy, its network, or other customers.
8.1.4 We receive a valid court order or request from a government agency.
8.1.5 We believe that your use of the service may subject RolaProxy to legal liability or harm our business interests.
8.2 Effects of Termination Upon termination of this agreement, you must immediately cease using all services, and any outstanding fees will be due and payable immediately. RolaProxy also reserves the right to delete your account and related data.
IX. Handling of Violations
9.1 If a user violates Chapter VI of this Agreement or related documents, RolaProxy has the right to handle the violation according to the following tiered mechanism:
(I) First Minor Violation
Applicable to: First-time minor violations (such as port scanning due to accidental operation, a single small-scale crawler attempt, etc.), which do not cause substantial damage and are not intentional or caused solely by negligence.
Penalties:
- Written warning (notified via email and in-site message);
- Restriction on the number of concurrent proxy IPs or daily withdrawal limit (not less than 50% of the normal limit);
- Rectification within a specified period (15 days). After verification by us, the user may apply to have all privileges restored.
(II) General Violations
Applicable to: Violations that have slightly affected the stability of third parties or services, or similar behaviors occurring again after a first minor violation (whether intentional or not), or violations that are intentional even if it is the first time.
Penalties:
- Account service suspension for 7-30 days (depending on the severity of the offense);
- Account balance is unusable during the freeze period. Upon expiration, an application for unfreezing can be submitted, requiring the following information:
○ Written statement confirming completion of rectification;
○ Relevant system logs or operation records (proving the violation has ceased);
○ Explanation of internal control measures for future compliant use.
We will complete the review and provide a written response within 5 business days of receiving the complete application.
(III) Serious Violations/Multiple Violations
Applicable to: Engaging in serious violations listed in Article 2 of this statement (especially 2.1 network attacks, 2.7 violating content, and 2.10 circumventing network supervision), causing significant losses to third parties, or accumulating three or more violations within one year. Penalty Measures:
- Permanent account ban, termination of all services;
- No compensation will be provided for the amount consumed in violation; the consumed portion will be deducted normally; the user's own cash recharge balance (excluding bonus balance) will be refunded after deducting the consumption directly caused by the violation;
- Bonus balance, event rewards, etc., will be cleared and will not be refunded;
- User usage records will be retained to cooperate with law enforcement investigations.
9.2 Violation Appeal
If you disagree with the penalty, you may submit an appeal application within 7 business days from the date of receiving the penalty notice, via email at support@rolaproxy.com or online ticket. Appeal materials should include:
- Your account name and registered email address;
- Screenshot or citation of the penalty notice;
- Explanation and evidence of the suspected violation (such as code snippets, authorization certificates, operation logs, etc.).
We will complete the review and provide a written response within 5 business days of receiving the appeal. During the review period, the original penalty measures will remain in effect. If, upon review, the penalty is confirmed to be incorrect, we will immediately lift the penalty, restore service, and compensate you for the actual duration of the impact (compensation will be 1.5 times the number of affected days, counted towards your account validity period).
X. Intellectual Property
This website and all its content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the property of RolaProxy or its content providers and are protected by international copyright and trademark laws. This agreement does not grant you any rights to RolaProxy's patents, copyrights, trademarks, or other intellectual property rights. You may not copy, modify, distribute, or create derivative works based on our content without RolaProxy's express written permission.
XI. Third-Party Applications
Any third-party applications you access during use are at your own discretion and risk. RolaProxy assumes no obligation or legal liability for any loss, damage, or liability arising from your use of or reliance on such third-party applications.
XII. Disclaimer and Limitation of Liability
This service is provided "as is" and "as available." RolaProxy makes no warranties of any kind, express or implied, including but not limited to any warranty of merchantability, fitness for a particular purpose, security, accuracy, or non-infringement. We make no representations or warranties regarding the condition, value, or quality of the service.
To the maximum extent permitted by applicable law, RolaProxy shall not be liable in any event for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to this Agreement or your use of the service, including but not limited to loss of profits, loss of revenue, loss of data, or business interruption, whether or not you have been advised of the possibility of such damages.
XIII. Agreement Modification and Notice
RolaProxy reserves the right to modify or update this Agreement at its own discretion at any time. Any modifications will take effect immediately upon posting the updated terms on this website, and we may notify you through website announcements, emails, or other appropriate means. Your continued use of the service after the changes take effect constitutes your acceptance of the modified terms. If you do not agree to any changes, please stop using the service immediately.
XIV. Governing Law
This Agreement and its performance shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without any conflict of laws principles that might lead to the application of the laws of other jurisdictions. RolaProxy's failure to enforce any right or provision under this Agreement shall not be deemed a waiver of such right or provision. If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire and exclusive agreement between the parties concerning the Services and supersedes any prior oral or written agreements between the parties.
